Officials from the California Department of Insurance are sounding the alarm about a disturbing scam targeting motorists involved in traffic accidents in Southern California. Dubbed the “vehicle hostage” scheme, this con has been increasingly prevalent, leaving drivers to recover from accidents while grappling with large, unexpected bills to retrieve their vehicles.

According to department officials, the scheme plays out when a tow truck appears almost immediately after a collision, offering what seems like a helping hand by towing vehicles to specific body shops. However, these body shops often demand exorbitant fees, frequently exceeding coverage limits set by insurance policies, before allowing drivers to reclaim their vehicles.

A recent investigation by the Inland Empire Automobile Insurance Fraud Task Force led to the charging of 16 individuals involved in a conspiracy that bilked victims out of nearly $217,000 through illicit insurance claims. The same group has also been linked to another scheme where vehicles were taken under false pretenses to California Collision in San Bernardino.

Victims should be on high alert for common red flags that could indicate a scam. These include:
– Tow trucks arriving shortly after an accident without any call from the driver.
– Drivers dictating which body shop the vehicle will be taken to.
– Unsolicited requests for signatures or assurances that someone will call.
– Recommendations for ride-share services after the accident.

Insurance Commissioner Ricardo Lara emphasized the vulnerable position of drivers during such incidents. “This type of scam is preying on drivers at their most vulnerable moments—immediately after an accident—when they should be focused on their safety and next steps, not fighting to get their vehicle back,” he stated.

To protect themselves, drivers are encouraged to verify the legitimacy of any tow truck company with their insurer or to wait for confirmation from the California Highway Patrol before allowing a tow. It’s also advised not to sign any documents until the legitimacy of the tow truck company is established.

For further assistance or to report suspected fraud, residents can contact the California Department of Insurance at 800-927-4357 or visit their website at insurance.ca.gov.
